DISTANCE SALES AGREEMENT
Parties
This Passenger Transport and Service Agreement (the “Agreement”) has been concluded between www.cypviptransfer.com (hereinafter referred to as “Cyprus Vip Transfer”) and the passengers who make a reservation from www.cypviptransfer.com and/or on whose behalf a reservation is made (hereinafter referred to as the “Passenger”).
Unless otherwise stated in this Agreement, “Cyprus Vip Transfer” and the “Passenger” are referred to separately as the “Party” and together as the “Parties.”
Subject
Through this Agreement, the Parties agree that Cyprus Vip Transfer will provide the transfer service for passengers from the airport to an address or from an address to the airport, using designated vehicles, for a specified fee.
Service and Payment Information
3.1 The Agreement fee, including VAT, is specified in the service details.
3.2 I accept that Cyprus Vip Transfer will charge the payment for the service I have purchased and/or will purchase via my credit card, and I authorize Cyprus Vip Transfer to perform the card charge.
3.3 The invoice for the purchased service will be issued within 7 days from the purchase date, in accordance with the Tax Procedure Law, without exceeding a month.
Payment Method: Bank Card or Credit Card.
General Provisions
4.1 The Passenger must comply with all applicable laws, including the Highway Traffic Law, and is required to follow all safety rules during the transfer, such as wearing a seatbelt.
4.2 If the Passenger purchases the service via credit card or bank card, they have implicitly accepted the written terms of this agreement, even if they have not signed it.
4.3 The Passenger must make a reservation at least 2 hours before the transfer time. For national holidays, religious holidays, and other official holidays, the reservation must be made at least 24 hours in advance. The reservation can be canceled up to 24 hours before the transfer time. In this case, the Passenger will be refunded. No refund will be made for cancellations outside of this period.
4.4 The Passenger has no right to change the route during the transfer. Requests to stop at different locations or delay the journey will not be accepted. In VIP transfer services, additional charges apply for requested stops at locations other than the ones specified in the contract.
4.5 Cyprus Vip Transfer will assign a vehicle that meets the number of passengers and luggage specified at the time of booking. All vehicles will have necessary insurance and safety equipment, including seat belts, spare tire, first-aid kit, and fire extinguisher.
4.6 Any luggage that exceeds the specified size or number will not be accepted. No refund will be issued in such cases.
4.7 The Passenger must present identification or a reservation document to the vehicle personnel upon request. If the reservation is made under another person’s name, Cyprus Vip Transfer may still provide the service at its discretion.
4.8 Cyprus Vip Transfer is not responsible for any lost or damaged items left in the vehicle. If the Passenger realizes they have forgotten something, they must contact Cyprus Vip Transfer immediately.
4.9 Cyprus Vip Transfer does not accept certain types of baggage, including sacks, trunks, and parcels. The Passenger must comply with baggage weight and size restrictions.
4.10 Pets can only be transferred in a secure cage, and prior notification is required during reservation. Only dogs, cats, and small birds are accepted.
4.11 Passenger Information
4.11.1 The Passenger will be informed about the reservation details via email and/or SMS. The Passenger is responsible for ensuring the accuracy of their contact details.
4.11.2 In shared transfers, the estimated pickup time will be sent to the Passenger 12 hours before the transfer by email and/or SMS. In VIP services, the Passenger can specify the pickup and drop-off times.
4.12 Cyprus Vip Transfer guarantees that the vehicle will be at the agreed pickup point at the designated time, except in cases of force majeure such as extreme weather or traffic.
4.13 In the case of a delay of more than 2 hours due to operational issues or unforeseen events, Cyprus Vip Transfer is no longer obligated to wait for the passenger.
4.14 Cyprus Vip Transfer is responsible for ensuring that the vehicle arrives at the agreed destination at the scheduled time, but if the vehicle is delayed, the company will cover the additional transportation costs.
4.15 The driver is not required to accompany the Passenger to their home or to assist with the luggage.
4.16 Passengers under 18 must be accompanied by an adult or have parental consent for transfer.
4.17 If a passenger requires a wheelchair, they must notify Cyprus Vip Transfer at the time of booking. If not, any related delays or issues will be the responsibility of the Passenger.
4.18 When using non-Turkish bank credit cards, an additional transaction fee may apply.
4.19 Passengers with infectious diseases must provide a doctor’s report indicating that they are fit for travel.
4.20 Delays: Cyprus Vip Transfer guarantees to pick up the passenger within 10-20 minutes at airports and 15 minutes for addresses.
4.21 Seatbelts: The use of seat belts is mandatory. The driver may refuse to continue the service if the passenger fails to comply.
4.22 Cameras: Vehicles are equipped with cameras, and footage is stored securely. The footage will not be shared with third parties.
Cancellations and Refunds
5.1 If the specified time or conditions are not met, the cancellation right cannot be used, and Cyprus Vip Transfer will not refund the fee.
5.2 Cancellations can be made via the online system or by calling Cyprus Vip Transfer’s customer service.
5.3 Cancellations made less than 6 hours before the transfer time will be considered a “no show,” and no refund will be issued.
5.4 No refund will be made for promotional services.
5.5 Refunds for credit card payments will be processed according to the bank’s procedures. Refunds may take 2-3 days for Turkish credit cards and 3-7 days for foreign cards.
5.6 Cyprus Vip Transfer is not responsible for any cancellation or non-performance due to the Passenger’s actions or omissions.
5.7 In cases of suspicious transactions, Cyprus Vip Transfer has the right to hold funds until the situation is clarified.
5.8 Refunds will be made via the same payment method. Any charges incurred due to refund processing will be deducted from the refund amount.
5.9 Cyprus Vip Transfer reserves the right to cancel or amend reservations due to force majeure events, with no obligation to refund the Passenger.
5.10 Behavioral Rules: Passengers must follow behavior guidelines such as refraining from consuming alcohol or drugs, disturbing other passengers, or eating in the vehicle.
5.11 Transfer of Rights: The Passenger may not transfer or assign their rights or obligations under this Agreement to another party.
5.12 Governing Law: This Agreement is governed by Turkish Law. Any disputes arising from the interpretation or execution of this Agreement shall be settled by the courts of Lefkoşa, Cyprus.
